SC to hear Amaranth
deaths petition on Sep 17
No plans of road
construction, facilities for yatris will
be improved: CS
VOS
Srinagar, Sep 09 (VOS): Amid accusations and clarifications on
Amarnath road construction controversy in the state, the Supreme Court of India
will now hear the case on September 17 instead of the September 10, on account
of non-availability of the bench which had heard the case earlier.
“The matter has been
mentioned by Ms. Vernika Tomar, learned counsel on behalf of the State of
Jammu & Kashmir and it is pointed out that the matter is listed on
10th September, 2012 before this Bench. As the matter has been heard substantially by a
different combination (Hon'ble Dr. Justice
B.S. Chauhan and Hon'ble Mr. Justice Swatanter Kumar), it is desirable that the matter may be listed on 17th September, 2012
at 2.00 p.m before the same
Bench”, reads an order passed by the Supreme Court on September 7 with regard
to Suo Motto writ Petition 284 of 2012, a copy of which lies with VOS.
“In the meantime,
parties are at liberty to file additional document / affidavit / report for
compliance”, the order adds.
Meanwhile, the state
government has reiterated that it has no intentions or plans of constructing a
permanent road along the cave route.
“The rumours of the
government preparing to construct a permanent road in the cave area are baseless,
and do not carry any weight”, Chief Secretary Madav Lal told VOS Saturday
evening.
The top bureaucrat said
that the case was coming up for hearing in Supreme Court and the state
government would keenly observe the outcome out of the hearing. “The Supreme
Court had directed to constitute a special high power committee (SHPC) for
devising the plans for Yatra, and the state government acted accordingly” said
Lal. He however was quick to add that there was scope for improvement in the
arrangements and healthcare facilities for the the Yatris which is being looked
into. “We have been improving the facilities provided to Yatris every year and
this will continue in future also”, the Chief Secretary added.
On July 13th, while
taking note of these deaths the Supreme Court had issued notice to the state and the central government apart
from the Amarnath shrine board, seeking details of medical and other
arrangements made available to the yatris. In its order, the court had raised
seven queries for the respondents to answer.
The seven questions
pertained issues regarding the yatra like medical facilities, essential
amenities, waste disposal, critical healthcare, high casualty rate and allowing
excessive number of yatris to visit the cave shrine at one time.
Subsequently, on July
20, the Supreme Court constituted a Special High Power Committee (SHPC) asking
it ‘to visit the site, examine various facets and submit its suggestions in the
form of a report’, in order to enable the court to pass appropriate directions.
Without limiting the scope of suggestions by the SHPC, the supereme court had
said, “The inspection by the SHPC and its suggestions should be aimed at
protecting the interest of the yatris, ensuring proper management, due regard
to environmental protection and ensure health care.”
The state Chief
Secretary had been appointed by the SC as the nodal officer of the SHPC with
the responsibility to presenting the report prepared by it before the Supreme
Court. Subsequently, the SHPC comprising top officials of state and central
governments apart from the security agencies visited the yatra route and the
holy cave on July 28, to take first hand stock of situation, in accordance with
court orders which had asked the committee to specifically take up the visit
while the yatra was still going on.
Meanwhile, official
sources said the SHPC has submitted its interim report to the Supreme Court of
India and the final report is being prepared. The report should be ready for
submission in time before the next date of hearing, they added.
Pertinently the hearing
in the apex court comes up at a time when various Separatist parties and Civil
Society have accused the government of concealing the plans of constructing a
permanent road leading to the hilly cave shrine.
However Govt had come up
with a clarification, saying that no directions of constructing a road in the
cave area had come from any quarter.
“We haven’t received any
such proposal or direction from any quarter.” State Forest and Environment
Minster Mian Altaf Ahmad had told VOS earlier this week. (VOS)
Kashmir can work as
bridge between India, Pak: Mehbooba
‘Leaving out JK out on
CBMs, dialogue amounts to ignoring people of state’
‘Goodwill created during
PDP regime has been wasted’
Srinagar, Sep 09 (VOS): While resolving to launch a massive
campaign for implementation of the Confidence Building Measures (CBMs)
announced by India and Pakistan, People’s Democratic Party (PDP) President
Mehbooba Mufti has said that Jammu and Kashmir can work as a bridge between the
two neighbours for forging friendly relations.
“Kashmir issue is
the main reason for discord between India and Pakistan. Leaving the issue out
of the ambit of dialogue or CBMs will not be acceptable to the people of the
state”, said the PDP President while speaking to media persons in a hurriedly
called press conference at her Gupkar Road residence here.
She said the people of
the state have been suffering due to animosity between India and Pakistan for
decades and leaving them out of the ambit of the process amounts to ignoring
and neglecting them.
“Since the wrath of
animosity between the two countries has been borne by the people of the state,
they cannot be deprived of the dividends of peace and friendship”, Mehbooba
said.
The PDP president said that
it was the positive approach of her party and the then state government which
paved way for Confidence Building Measures in 2003 and convinced the two
hostile neighbours to restart the dialogue process. “It was during our
government that the then Prime Minister Atal Bihari Vajpayee extended a hand of
friendship towards Pakistan from Kashmir itself”, she added.
“It was due to the
tireless efforts of our party that the routes across the Line of Control were
opened for people to people contact apart from initiating the Cross LoC
trade.”, she said. However, she said all the good will created during the PDP
led government has been wasted.
Mehbooba, while
demanding provision of banking and communication facilities for the cross LoC
trade said that the present dispensations across the border have since failed
to move forward on the key CBM. “Our party has offered many sacrifices for
opening the cross LoC routes”, she added.
“14 workers of PDP were
killed in 2004 Uri March and another was died when traders had called for
Muzafarabad March in 2008”.
Mehbooba said all the
gains accrued during the PDP rule with regard to building confidence among
people of the state. “Neither did we believe in harassing people nor were
people detained on one pretext or the other. The present government has even
jailed 11 year old kids”, she said adding that taking oppressive measures and
shrinking of political space by the government can have serious consequences.
“Enforcing silence on people cannot be termed as peace. Many political leaders
are not allowed to pray on Fridays and Eid”, she said.
Reacting to a question
on the agreement between the two countries to ease the Visa Regime, Mehbooba
said the peace dividends are being reaped by others while the people of the
state are suffering. (VOS)
Engineer reacts to Dr
Farooq’s Statement
‘Show some respect for
Kashmiris’ sacrifices’
Langate, Sept 9: Reacting sharply to National Conference
President Dr. Farooq Abdullah’s remarks that New Delhi will never beg of the
separatists for talks, MLA Langate Er Abdul Rashid today asked the NC president
to exercise restraint and show some respect towards sacrifices given by
Kashmiri People. The fire brand leader also advised Dr Abdullah and his party
men not to pass ‘irresponsible comments’.
While addressing a
public gathering at Lachampora Rajwar in frontier district of Kupwara, Rashid
said, “Had NC and its leadership performed its duties towards Kashmiri People,
situation and history would have been all together different”.
He reminded Dr
Farooq of ‘the failures of NC leadership including Late Sheikh Mohammad
Abdullah in playing a historic role which it could and should have played since
1947 till date’.
Er Rashid said that it
was because of NC's failure and double standard that Kashmiris had to resort to
armed struggle. He accused the NC of failing to deliver on political front to
meet the aspirations of Kashmiri people.
“People created
atmosphere and space for bringing Hurriyat Conference into existence”.
The MLA asked NC to
respect sentiment and aspirations of Kashmiri People and reminded them (NC)
that Kashmiris have sacrificed at all fronts for the resolution of Kashmir
issue and not for futile talks. He said that Indian State has been always
trying to buy time since 1947 as it stands at a very weak pitch over Kashmir
issue. He said that it has been Govt of India, which has been begging for talks
sometimes through track two diplomacy, sometimes through agencies and sometimes
through retail shops of so called Kashmir Committees, but has been never
sincere to resolve the long pending dispute.
He Rashid reminded Dr.
Farooq that it was New Delhi which always in the name of talks offered a cup of
tea to Kashmiri Leadership but fulfilled its bad designs by exposing them to
its own people.
